If there's a crime scene or threat nearby then its protocol to clear there area. Just becuase you're sitting under a tree doesn't give you the right to make things worse, and being asked to leave doesn't mean you're doing anything illegal or that you can't just find another tree to sit by. there's lots of reasons that would require the police needed to clear the area, she could probably go back after whatever it was is cleared.
