I'd say at 10 he fully understood what he was doing, hurting another human. All because she asked him to leave, imagine what could happen if he felt a more drastic reaction was ended to teach someone a lesson down the road?

But the fact that he said "I was just trying to hurt her", it speak volumes that he intended to make her pay so to speak. He understand that he was going to be hurting her, and proceeded to grab a cane, throw her down, jab her then punch her.. I can't see how he didn't understand what he was doing.

And they may very well be held against him in court but I work with children who are developmentally delayed, some with violent tendencies... They know pain because they feel it obviously but they don't know or really have a true understanding of controlling their outbursts. It's hard to explain because each child is a different case but it's still something I hope they consider.[spoiler]i once had a child bite a chunk out of my arm because I wouldn't let him sit in his favorite chair.[/spoiler]

Yeah I understand what you're saying, but I personally feel that he deserves a full punishment.

They may not truly understand the consequences of killing someone, which spares them from the death penalty, but they do know that they're hurting people, and we've got to keep people like that locked away from the rest of society no matter how old they are. Adults always deserve death, unless the murder is deemed to have been committed in self-defense or as a crime of passion, i.e. if a man kills a rapist after catching him with his child.
