It's not their right to eat at his restaurant. It might be nice to eat at a bigots restaurant but it is the bigots restaurant.
Since you can't learn from history I'll create a situation. And since I am typing this a second time due to my retarded Mac, I'm keeping this shorter. A country attacks and succeeds in kicking US troops out of a region. The fight was bloody and casualties were higher than what we've seen in decades. US citizens express their guilt and fear by hate on an ethnic group common in the attacking country. Sympathizes to the ethnic groups are treated as traitors and low lifes. Businesses begin denying services to the ethnic group to avoid a bad rep. The ethnic group now can't find or is hard press to find places that offer basic necessities such as food and gas. They take it to the courts but the judge rules that business have the right to deny service to anyone. This fueled the hate against said ethnic group and destroyed many legal implications of denying ethnic group services. Lots of people pertaining to the ethnic group were fired, denied service, and mistreated by society. Families begin starving, dying of sickness, and became homeless.
If that is the case, no law will protect people from discrimination. Every day you step outside, you are relying on the morals of your neighbors not to harm you.

That's a good history lesson, IF the country were 60 years ago and everyone was racist. But this guy is a needle in a haystack. Your example wouldn't happen, because not everyone thinks like that. That's a very hypothetical situation.

It was pretty close 13 years ago

All restaurants reserve the right to deny service to anyone. Again, he's scum, but it is a right.
