In that case, he only can be seen by Batman when he wants to be. If the Doctor ultimately plans on killing him, he could just go to a planet that has that containment field thing that was in the first season of Torchwood. Bats would be trapped inside once he is found and then the Doctor would just usher him into the Tardis and drop him out into a Black hole.
