if their going to restrict used games it will likely make the consumers more cautious as to what there going to buy which is not good sales will be down except from consumer trusted devs like bungie.

Exactly, and many game series that I buy for now, I never would have gotten started on them in the first place if it weren't for used games. Like I never would have cared about getting the Metroid Prime Trilogy for the Wii if I'd never found Metroid Prime used. And I never would have cared as much about Halo if I hadn't been able to find used copies of the two games that came out before Halo 3. Used games do nothing but help the market, and they were never a problem to begin with :/
