The lawsuit is justified.. The game was nothing like the unfinished product in the trailers..
-Horrible AIs that were not Dynamic
-Horrible CoD like combat
-Mini-Boss was terrible
-Where is the scene were they put down a Sentry -gun down that narrow hallway underground?
So much was just wrong and missing.
By the way.. it's easier to make a game to be as advertised than it is with food.

I've seen some people comment that, for all its flaws, they still like Aliens overall. So that's not proper evidence for this case. As for the trailers, again. It's advertising. If I'm a company, my goal for advertising is to pick the parts that look as pretty and appealing as is humanly possible. I'm not going to show off the bad parts. Is it going to win me any fans? Not in the end, no. It could actually damage my reputation, as we are seeing in this situation, but in the end, it's like I said: buyer beware.

But the point is is that those parts that are all dandy and lovely aren't even in the -blam!-ing game! Don't you get it?! With your McDonalds analogy that would be like saying that with every Happy Meal you get 5 bucks, only when you buy the actual -blam!-ing product you don't get those 5 bucks at all. It isn't a problem that they did advertise all the nice things about their game, everyone does that. The point of this lawsuit is that those nice things are not even in the -blam!-ing game. So they falsely advertised their product. Fact.

Is this really the case? Okay, I'll admit to not knowing that. I still don't want Gearbox to lose this. Like I said, this will just open the door for lawsuits that are much more frivolous, except then they'll actually have this case to stand on. It's a bad precedent.

I want them to lose and crumble badly. Hopefully it will make them and all other game companies realize you can't lie to the customers and get away with it. It won't open any pandora door of awfulness either. It will just make them realize they can't get away with crap like this. I bought the game because according to what they showed and advertised the game would look like they showed it. I get the game and it's not even close. Many sections of the game have awful gameplay breaking issues and original xbox style graphics. There is a difference between 'artistic creativity' and just simply jipping your customers. Other game companies or I should say almost all wouldn't have to worry about any lawsuit. When I see a BF3 trailer those graphics and gameplay are almost exactly what it looks like in game. You don't see anyone suing them now do you?
