I personally think the death penalty should be for all crimes, we'd just have to redraw the lines for what makes a crime.
Kill enough people and it won't be done anymore.

That sounds a lot worse than I intended it to, but to the point: People are too optimistic. No one ever thinks they'll be caught, they think they know how to get away with something, and they end up getting caught anyways. In states where murder in the first class is just about a guaranteed death penalty, people still commit murder in the first class. It doesn't stop them in the least. While I don't agree with their lifestyle, they're doing something they feel they need to do. And obviously, fear of the law doesn't stop them at all, even with a death penalty attached to it. They're going to do with they want to do and assure themselves that they won't be caught. Edit: Go home Bungie censors, you're drunk.
