Yes, it is ban-able. Is Bungie actually going to enforce it? No. They're too busy dealing with Sony and the dumpster fire that is the games never ending list of bugs.

Bungie has never banned anyone for kicking someone from their fireteam.

Obviously not. But it's considered a no no in the eyes of Bungie, as intentionally kicking someone at the end of a raid / dungeon encounter so they don't get loot, is considered griefing, unsportsmanlike and disruptive behavior.
