The lawsuit is inevitable but also guaranteed to lose because we all agreed to the terms without reading them but even if we did, would any of us delete the game because we didnt agree with it?

If you've been paying attention, they often make changes to the SLA. Particularly with large updates. When these changes are made, you're asked to agree to the SLA again. If you've been playing Destiny since launch, you've probably agreed to a few of these, though if you're on auto-pilot, you may have just spammed X/A past it... Anyway, you can just choose to decline at this point park up Destiny and apply for a refund. Which is what I did with the Shadowkeep update and got refunded for the base game as well as all the DLCs up to Forsaken...
