I am unsure if I am missing something here, but as far as I am aware Code of the Siege Breaker's Hammer of Sol does create a Sunspot upon activation of the Super, at least while you're on the ground during activation. It doesn't work in the air though.

wow, just tried it again and it actually does create one lmao, guess ive had a habit of activating it in the air all the time ive been playing then...

I know that habit, I do it as well. Probably because you don't stop moving when you activate it in the air. It can happen though that it doesn't create a Sunspot even on the ground. Rarely happens on uneven environment.
