• While that may be true, and I have no sympathy for him the person, as this the event it is super scary. Police are essentially being slowly granted the right to place to be cop, judge, jury, and executioner. Which directly violates a few of the things America stands for. Due process in the case, being one of them.

  • Not really, no. He was convicted of the misdemeanour of carnal knowledge of a juvenile, which means the person he had consensual sex with was between 13-17, and he was over the age of 17. When you say 'pedo' and 'rapist' you imply he had sex with a child which wasn't consensual.

  • Minors can't give consent to sex.

  • Yes, they can, regardless of what the law may say. Claiming a 16 year old can't give consent is ludicrous.

  • Physically, sure. Mentally, no.

  • If you can't make competent decisions by the time you're 16, you're mentally ill or delayed in my eyes. I'm not sure what kind of 16 year olds you've seen in your life, but I assure you the ones I know of are more than capable of taking care of themselves. Perhaps you've seen or are hanging around the wrong type of crowd. But the age of consent is extremely subjective, and it's apparent we have conflicting views on it. Not all teenagers are the same, but you should be expected to make your own decisions by 16, possibly earlier.

I dunno what the law is elsewhere, but here in NY, if you are under age you can have sex, but only if you are both between 12 and 16.

  • Yeah, it's different everywhere, and I'm not even from America so I'm not going to try to get into the specific laws for all of the states.
Misdemeanor carnal knowledge of a juvenile A. Misdemeanor carnal knowledge of a juvenile is committed when a person who is seventeen years of age or older has sexual intercourse, with consent, with a person who is thirteen years of age or older but less than seventeen years of age, when the victim is not the spouse of the offender, and when the difference between the age of the victim and age of the offender is greater than two years, but less than four years. B. As used in this Section, "sexual intercourse" means anal, oral, or vaginal sexual intercourse. C. Lack of knowledge of the juvenile's age shall not be a defense. Emission is not necessary, and penetration, however slight, is sufficient to complete the crime. D. Whoever commits the crime of misdemeanor carnal knowledge of a juvenile shall be fined not more than one thousand dollars, or imprisoned for not more than six months, or both. E. The offender shall be eligible to have his conviction set aside and his prosecution dismissed in accordance with the appropriate provisions of the Code of Criminal Procedure. F. The offender shall not be subject to any of the provisions of law which are applicable to sex offenders, including but not limited to the provisions which require registration of the offender and notice to the neighbors of the offender. Acts 2001, No. 796, §1; Acts 2008, No. 331, §1.
He would have been 21 or 22 when he was convicted.

  • Well yeah, I already read the description of the crime, but I was referring to the states have different consent ages. I recall looking at a chart showing the different laws.

  • True, but the law is there to protect them from making life ruining decisions. In my experience, many 16 year olds aren't necessarily irresponsible, but more immature. Also, you mentioned the person he had sex with was 13-17. That's a pedophile in my point of view. Legality doesn't make morality.

  • I wouldn't call him a pedophile unless it was a completely undeveloped 13 year old. As weird as this may sound, there are plenty of 14+ year olds out there who look like they're in their twenties. But there's nothing hard left to comment on unless we saw a picture of the girl around the same time they had sex, and that's just getting a little too invested into this issue.
