He was brainwashed and a controlled hollow shell. They gave Scarlett witch and quick silver second chances. Which would explain why ant man would be on Captain America side. We have really no clue what the plot will really be about to say one side is better than the other. In the original comics Tony was a douche. But this is the Cinematic Universe and they will do whatever they wish.
