I agree with your second point, not so much with your first.

I see why but he was waving a gun around near kids. They guy could have shot the officer and then shot the kids. I wouldn't have taken that risk

If it means less lives being lost, I'm with whatever choise is better. But for now, I see keeping him alive better.
