1. You won't win regardless. But... 2. In all actuality, those Eula's are not recognized in a court of Law. They are NOT considered a legal binding document as they are not endorsed through the judiciary system.

Funny you mention that, when I updated yesterday I had to agree to the terms... Most of the games have the terms right there and you can scroll through and hit accept, but destiny nope... Here's a link so you have to punch it in to read it

Not necessarily. I'm not saying anyone has a case at this time, however, ToU, EULA, ToS and the like are not bullet proof. If they were you would never hear about a company being sued. Also look how many times the EULA has changed just in a year with this game, 3+. That's unheard of. So, clearly they are covering their ass about something. For those who breathe through their nose, this is obvious.
