I've said this elsewhere but it's worth saying again.
Lawyers make a lot of money from lawsuits, especially class action lawsuits. With millions of people playing Destiny, any lawyer that took on Bungie and won would more than likely be able to retire if they wanted to. The fact that we aren't seeing/hearing of any lawsuits, is probably because the professional lawyers realize there is little to no chance of building a case that will stand up in court. Think about it for a minute, Lawyers jump all over every accident, plane crashes, vehicle accidents, like you mentioned, even someone spilling hot coffee on themselves. If they had the potential to make millions off of a case against Bungie, everyone would be contacted in order to build as many "witnesses" as possible to prove their point.
TL;DR: Professional Lawyers aren't interested in a case, so it either doesn't exist or isn't worth fighting over.

Lawyers don't go to people for cases. The only type of things you see from lawyers when they are looking for clients would be commercials regarding workers compensation since that is a huge problem in America. Lawyers do not create lawsuit cases and wait for people to bite. Enough people have to build the case themselves and they go to lawyers. If enough people due for the same thing then it becomes a class action lawsuit where multiple clients come together instead of suing separately.

Regardless, if there was a case to be had, someone would have approached a lawyer and they would be looking for more people to build the case. There are no known ongoing lawsuits going on, probably because, while not morally right, Bungie didn't do anything illegal. I'm sure they pay their legal team a visit before they make decisions regarding the game and it's content, or at the very least the waiver we signed in order to play in the first place.

People do sue over things that are immoral.
