I'm saying if he's using the last bullet on malice he will be damaging himself, mean I can probably two shot him. And also the apple of discord the vanguard sells shoots 4 shots per bust, does a 25 crit hit. Land all crits (which I must say doesn't happen a lot) and it can two shot

You missed the point. The Touch of Malice hurts you when you shoot it making it easier to kill you.
