I'm thinking a junkie that needs to steal a kid's xbox in order to score probably doesn't have a lot of cash on hand or earning potential for that to be a viable option.

You can't, you may be able to get some damages in civil court but it wouldn't be more than few thousand and you have to pay a lawyer

Yeah I'd leave that one up to the DA to try him in a criminal court rather than civil.
