I'm not an xbox player, but I don't think that being max level should be a requirement. That's just discriminating and some people may not have the chance to raid all the time, and thus cannot get the shards to get to 32. If you're creating a raid group but won't allow the people who actually need shards to join, it's kind of pointless in a sense. Just my two cents though, do what you want.
