Streaming is not a 'commercial use'. Bungie's Terms of Use explicitly state that you may use Bungie's content to create content of your own and that you may use that content on a page of your own where you also ask for donations.
GAME CONTENT USAGE RULES All of your use of the Bungie Content must comply with these Terms and the Content Usage Rules (as defined below). You may use game footage, screenshots, and other elements of Bungie games that are owned by Bungie (“Bungie Content”) to create your own content (“Your Content”) provided that you must comply with these Terms and all of the following restrictions (the “Content Usage Rules”): You can use Your Content on a page on which you make a donations request.
7 RepliesWhat is your issue with streamers? They are just human beings that are good at gaming. Why not support them if that is your thing? If players are making money off of trials, it is because of their talents(most, not all) and not because of commercialism. If they get sponsored, it is because of their talents and persona, not "A" game. An example... I own a bar. I do not make the alcohol, other companies do. I purchase the alcohol that I think will sell the best(destiny). People(gamers) come to my establishment because of what I provide to them. If I am not good at what I do, people will go elsewhere. Same thing as twitch. The better you are, the better you will do. Their service is them, not the product. They do not make money because of "destiny" or what other games they play, they make money because people support them for what they provide. Commercialism is there, but it is up to those to support those players that choose to partner up with companies such as turtle beach, scuf etc... There are phenomenal players out there and I have met some great players and I have donated... not to get perks, but to give them support for all their time they spend helping TONS of players. Those players exist period. Trials or whatever else would still be man handled by players with talent... But now, if you choose, they have opened the door to watch them play for either enjoyment or for educational tips and now play with them. It is an option, and I think it has done wonders for gaming.

1 ReplyTerms of use, the most under read and under enforced document in the world. You can always do like I do, don't play Trials. I understand your frustration. I don't understand why people pay to get carried. I don't understand the fascination with watching other people play video games. But the market is not going away.

4 RepliesStreamers are huge tax evaders. They don't claim their stream money(income) on their tax returns. It's time for an audit and for twitch to be shutdown.
-
Unsolicited is the key word there, big streamers are partnered with twitch

7 RepliesEdited by Culture: 2/7/2017 7:30:09 PMAs someone who makes money off trials and twitch, why are you so angry? If you get 5-0d by me doing a carry, me in a stacked team wouldn't be any better. You get farmed get over it.

3 RepliesEdited by rick23452: 2/7/2017 8:59:12 PMYou need to get over this. I understand you don't like streamers in trials, but it's not going anywhere despite you not liking it. Fact is a lot of people tune in, the subscribe and donate money to these guys. Yes Bungie could decide that they don't want their game made. Into videos, or streamed, and get them shut down, and the creators would gets copyright strike against them. However it's obvious Bungie allows this, they promote it. They have a contest for movie of the week. They fly these guys out to the studio to play new content. Why? Because these guys get the word out to a lot of people about their game. It would hurt Bungie to stop them from making vids, or streaming. Ya, they aren't about to give up their legal rights in regards to their IP, that would be stupid, but that doesn't mean they disapprove of the streamers, or youtubers.

Time to send in the SWAT team to every streamers house/basement!

8 RepliesYou seriously need to get over yourself. "Wahhh I got beat by someone who's better than me" "waahh I'm not good enough or charismatic enough to make money streaming on my own." "Waaahhh I want me participation award because I tried my best and that's what my mom says really counts" that's what you sound like. Grow the -blam!- up. Sorry but I'm not sorry.

17 RepliesEdited by Riv3rMon5ters: 2/7/2017 3:44:52 PMThe bigger question is who are you to take someone else's livelihood away from them? Sounds like a d*** move to me.
-
Free carries are perfectly acceptable- not a fan of paid carries or account recovs but they dont usually affect me so meh.
-
19 RepliesIf bungie hasn't responded to any of ur 8 million posts, I don't think they give a -blam!-. Just saying. Also, deej said b4 that bungie isn't persuaded by amount, so ya should stop spamming topics. Just my 2 cents.
-
1 Replynone of the parties are caring about terms of service as long as they're making money. streamers keep trials alive and therefor keep game alive, make money off of carries and twitch ad revenue bungie makes money because people keep playing their game for trials twitch makes money because people are using their site, watching ads on it, etc. everyone is making money. that doesn't mean its right, but its whats happening.
-
4 RepliesYou're still going on about this?
-
5 RepliesBy opting in (ie, choosing to watch a stream) you're no longer in 'unsolicited' territory...
-
19 RepliesI think we're digging a bit deeper than is necessary here. Unsolicited offers etc doesn't really count if you are watching the channel of the person making those offers. It's different if you receive junk communications from someone you've never watched or engaged with. Are you in their house or are they in yours? That's where the difference is here.
