I think if you click purchase it'll say you already own it and download for free. That's what it did when I went from 360 to one.

I'll just stop buying 360 games at this point if this is how licenses work on these consoles, no point in putting more money into an older console if I already bought the new one. Just a shame, I can't play Destiny with the friends I have that aren't on Xbox One.
