QOS Class Action Lawsuit
I like destiny a lot, but for me, PVP has been a turd. That's due to the amount of lag I get from being over 2400 mi. from the server. "Heavy ammo available", I've already got a rocket up my rear. "Spark is available", someone has already stolen it. The list of things going wrong goes on and on. We are being charged the same price as someone right next door to the server and receiving substandard service. There should be a Quality of Service lawsuit against XBL and PSN.

1 RespuestaWhy against Microsoft and Sony. It's not their fault bungie made it p2p connection. Even then you can't sue bungie because you agreed to the terms of service. If you try to sue them a court will dismiss it because of the ToS then bungie has the right to sue you for breaching the ToS

Your problem isn't servers, it's the number of people in your area who play Destiny and happen to play when you play, and what you play. That is not grounds for a lawsuit. You have no grounds for a quality of service suit either since there is no bar for quality that they are required or expected to meet. Your problem is your own, not theirs.

14 Respuestas"Player Experiences May Vary" I haven't checked for Destiny. But many online only games put this somewhere visible as a disclaimer so they cannot be sued for the exact reason you posted. Make sure to check for that, and the entire EULA (End User License Agreement) and TOS (Terms of Service) for anything that may include the issue you are having. If you feel your experience has not been covered in any of these, then you may be able to take legal action.

There are lots of guides on how to do it, and it would only be a marginal cost on everything you would loose in court fees, lawyer fees, and probably a counter suite for a bogus lawsuit. Sony or Microsoft would probably go after you to pay their lawyers for wasting their time, and they don't use lawyers who advertise late night on TBS. Sorry pal.
