They will however most likely lose their job. The ESRB rating on a game isn't a law. It's a guide to inform parents and children alike of the content included in a game. It's no different than the MPAA system in place for movies. Legally, you could sell a ticket for Deadpool to a 5 year old. You will probably be fired on the spot, but you can do so. The ESRB and MPAA for that matter "are more like guidelines than actual rules" as Captain Barbosa would say. I'm a former GameStop employee and current AMC employee. I know what we can and can't sell.

2 RepliesGamestop man f- that company I drove up there one day with my little brother I sent him in to pickout a game cause he earned some money doing chores for me, and they wouldn't sell it to him so I was like okay I'll come in and get it for you and I was 20 at the time they were like are you his Guardian or Parent? I was like no but I'm his brother and they'll be fine with it and they refused to sell it to me. Never going back to Gamestop again, Amazon and the Xbox Digital store from now on!!

It depends on the definition of the rating, for example in Australia the M rating means mature audiences recommended, so this can be sold to anyone. Whereas our MA15+ is restricted; unsuitable for persons under 15 years of age. They key word is restricted.

As far as I know, it is? But parents are still able to buy for their kids.
