A child who suffered serious health defects owing to her mother's drinking during pregnancy deserves compensation, a local authority will claim in court.
The council will argue that the child, now aged six, was a victim of crime.
Her mother is alleged to have effectively poisoned her daughter.
The upper tribunal of the Administrative Appeals Chamber has given permission for the case - brought by a council in north-west England - to be heard in the Court of Appeal.
What are your thoughts on this Floodians? Is it a valid lawsuit? Or does the child have no rights until birth?

Edited by im am b0red: 3/9/2014 5:48:24 AMUnbelievable. You can legally kill the thing because its a fetus but you can't hurt it? Dafuq? "Hey cop I just shot this guy" "Did he die? " "Yup" "Lol nice shot!" "Wait, I think he is actually alive.." "You're going to jail dirtbag!" Can't imagine what the world will think of our laws in 100 years... Legal murder of hundreds of thousands...
-
but you can -blam!-ing murder it? k
-
I'm all for bodily autonomy, but you don't have the right to harm another human in the process of exercising that bodily autonomy.
-
It would be different if she was gonna get an abortion. The suit is valid.
-
It's a frightening thing that her mother was that reckless. I think she deserves compensation.
-
After reading through some of these comments, I wonder why people call conservatives the "brutal" and "not caring" party.
-
Either way, if I stated my opinion, there would be people bashing me for it on both sides, while one side would be bashing much, much more than the other side, guaranteed.

Given a fetus is not a human being until conception I say its a pretty bad case. Abortions are allowed some places up until 9 months. So really if they go this step they should charge the parents of every kid that has fas? Wont do that than why bother? Its not a human being up until conception so what the mother ingests into er own body is her and her choice only. Its a slippery slope, start charging mothers who dont take pre natal vitamins or eat unhealthy which also causes negative effects on a baby?
-
y'all dumb for voting that it isn't valid.
-
I'm too tired for this shit.
-
It is a completely valid lawsuit. A human being is a human being from the moment of conception.
-
Valid, absolutely. If you are seriously considering bringing a child into a world not taking of it is nothing short of neglect.
-
Valid.
-
If you are responsible enough to create life, you should be held responsible to protect it. Otherwise be smart and don't have a kid. I agree with the local authorities in that case.
-
If you have an intention of actually having the kid grow up and become his/her own person, it's not fair to poison them before they're born to cause health problems afterwards.
-
IF YOU DECIDE TO HAVE SEX THEN PLAN TO NOT BE DRINKING FOR NINE MONTHS.
-
Fairly certain I already inb4ed half these replies, Flood.
-
so let me get this straight, its ok to let a woman kill the fetus in an abortion but its not ok to harm the fetus in utero and then give birth to it? in my opinion both are very complicated issues and im currently indecisive on both of them, but you dont get to have it both ways. you can either declare the fetus a living being and grant it all legal protection any other human gets, or you can protect women's sovereign right to their body and what they want to do with it, but you have to recognise that your choices come with consequences and you cant say that just because a baby was born it had every natural right that we give all people while it was in the uterus and then say that just because another fetus died in the uterus, intentional or not, that it never had any rights to begin with.
-
Why do they drink while pregnant?
-
It's an unfortunate situation, but I do not believe she should be charged. It is her body, and what she chose to do with it was her decision. Denying her those choices is tantamount to denying her her bodily autonomy. I also do not believe foetuses should be given rights (or at the very least, the same rights we do). That is essentially a slippery slope where a woman is held hostage by her own body.
-
LOL At all the pro life people in this thread not having a clue what they're saying. You can smoke and drink all you want, if you're aborting a FETUS. If you're going to have the HUMAN BABY, you should not smoke or drink because that is CHILD ABUSE.
-
It is an idiotic decision by the mother however one cannot be charged with having a drinking problem, whether it hurts the child or not
-
It's more than valid, mothers shouldn't drink while pregnant. Yes, we don't know the exact dangers of drinking whilst pregnant, but that should be enough reason to not have any. Who would risk their unborn child's health to drink alcohol? That's a serious question, not just some rhetoric. I hope they bleed her dry to give every last penny to the child, she should pay for he stupidity. It wasn't just Alcohol, it was drug abuse as well. It's not a case of 'Oh she had a glass of wine, time to rake her over' it's a 'You -blam!-ed up your child with your own selfish ways, now you will be held to account for that'
-
Edited by LH Justin: 3/7/2014 4:25:36 AMWhile I feel sorry for the child, I don't think the mother intentionally "poisoned" the child as these people are claiming. As far as I'm aware drinking while pregnant in the UK is not illegal, so they don't really have a legal standing to sue her. I feel bad for the child, but the mother didn't have malicious intent when she was drinking. Morally, I'm not sure what the answer here would be. Legally, the mother is innocent.
-
Of course it's valid, she was heavily drinking knowing she was pregnant.
-
Pregnancy, aside from -blam!-, is a choice to bring life in the world and if you're going to abuse it then you're going to pay the consequences. If you're going to bring up "hur cus it cant survive on its own den its not living" then is a fetus dead? No, it's a living organism. And by the quotation marked logic, then it's fine for parents to kill their children since they can't survive on their own and must be dependent on the parents
