It would have been fairer if BOTH consoles got the BETA at the same time and those that pre-ordered (on whatever console they have) up till say E3 got in the BETA a few weeks early.

Im going to guess here. Bungie has worked with MS in the past. They are blocks from one another, in the same city. Im going to guess Bungie is quite familiar with the infrastructure/servers MS is working with, but not so with Sony. The beta is basically a server load test.
