Ok to start off I'd like to say. I love free speech. I like saying what's in my mind when it's on my mind.
That being said I feel this is abused by people. The law has "fighting words" that are basically obsolete.
Fighting words as used in law used to protect people from persecution after beating someone's ass after being insulted.
Eg. If I walked up to someone and called them a dirty -blam!-ing Jew and they beat my ass they wouldn't be persecuted within reason. Obviously if they killed me or crippled me yes.
However this is no longer the case. These fighting words are no longer used and people abuse this they insult each other. In very crude and immature ways because they know the person they are insulting can't do anything without risk of persecution or being sued. I think people should start taking their words more serious. And start to realize that just because you CAN say anything doesn't mean you should.

3 通の返信So is the line drawn in the amount of damage in the fight resulting from the "fighting words" or is it drawn at the words that were spoken that lead to the fight which had unacceptable injuries? Or is there a sliding scale that certain insults are worth a bruise but not a tooth knocked out, but other words can justify a broken jaw but not a crushed larynx? At what point does the speaker have total responsibility for the listener's rage and physical strike, at what point does the listening attacker start being responsible for their physical reaction to sounds in the air? And what if the insulter is attacked but then the insulter pounds the one they were insulting? They both started it and ended it with the most damage inflicted. This all seems very complex and would involve some sort of mathematical association of numerical values to verbal statements that are counter-balanced against the actions/results of a physical altercation.
