Matthew Kelsey Martineau, who was writing under the pen name Caspar Cole in 2013 and 2014, alleges that Bungie’s 2017 Red War storyline bears “deliberate and intentional” resemblances to his own published work on his WordPress blog, including the backstory of the main antagonists, the goal of capturing a massive celestial power, and the use of a superweapon as a threat.
Martineau’s complaint points out additional similarities between his work and Destiny 2’s, including calling elite troops legionnaires, dog-like beasts, the concept of consciousness transfer, and the use of a fail-safe tool (that isn’t specifically named Failsafe) to avert disaster.
Martineau is seeking a jury by trial and relief in the form of statutory damages, legal fees, materials related to the Red War narrative, and a constructive trust over proceeds Bungie earned as a result of publishing the story. Bungie has yet to make a statement about the lawsuit.

They have no legal standing. Dog like beasts cannot be copyrighted, neither can any of it really. He wasnt the first person to use any of those ideas nor can they be attributed to him prior to Bungie (Destiny has been worked on since like 2010 and most of what we get now was scrapped ideas from the past). Even if it is taken to court the guy is just gonna get humiliated.

2 通の返信Doesn't there have to be proof that Bungie had even heard of that other story before. George Lucas is going to come calling with an army of lawyers for the whole ghaul/mentor, darth vader/emperor thing if that case is allowed to fly.

The examples of similarities the plaintiff lists fall almost entirely within four categories: • [b]Details with Easily Identifiable Real World Analogues[/b] - members of a “Legion” being referred to as “Legionaries”, an invading army proclaiming their superiority over those being invaded. • [b]Standard Science Fiction Tropes[/b] - battles spanning terrestrial and space settings simultaneously, orbital stations, massive “doomsday” weapon systems. • [b]Plot Points that Follow Logically[/b] - a social outcast gaining political power under the tutelage of a crafty mentor, a civilization under invasion using an emergency broadcast system to warn its citizens of said invasion. • [b]Nonsensical False Equivalencies[/b] - saying the character “Failsafe” within Destiny is based on a reference to “the digital input panel on the atonizer prototype” which has a [i]fail-safe mechanism[/i] that can “reverse the effects of an enhancement beam and permanently alter the physics of the surrounding area for a certain period of time”*. The merits of the lawsuit as originally presented are incredibly underwhelming, to say the least.
