I'm indifferent to how it currently works if I'm honest. I can choose to not play much crucible atm but the fact that you know and have stated that it will lead to "low quality" matches while actively choosing not to address it is pretty bad imo.
It's kinda like saying "we know our product is broken but we'll monitor the amount of complaints we get before deciding if we will fix it or not"
I get Forsaken is just around the corner and things will probably change then but it really doesn't instil much confidence from the player base going forward.
For me personally it's just cemented my decision not to pick up Forsaken on release. I'll monitor TWAB, the forums and player reviews while I play other games. This is from someone that has D2 on ps4 and pc with a shed ton of hours logged.

I doubt it's against the law tbh but on the face of it it just comes across poorly. Maybe there's a better reason than they just to monitor it but atm that is all we know. There could be a perfectly valid reason we just don't know it. All we know is they made the choice to leave a bug in that they know by their own admission will result in low quality match making/games.

A bug in a video game, no matter how big or small should be patched. That's essentially selling a broken product. BMW sells beamers with a bug that sometimes prevent the brakes from working. That's acceptable?

It's not acceptable but BMW would do a cost analysis first and way up if it was cheaper to pay out claims or recall the car. Sad as it is, that's the world we live in. Look at Batman that didn't work full stop on pc release. It wasn't illegal and they didn't even stop selling it for a few weeks. Ultimately the bad press forced their hand. Bungie/Activision are a huge company that knows they will still take in the cash regardless of this current issue and let's be honest, D2 as a whole is in a pretty good spot atm imo. For me personally all it's changed is wether I pick Forsaken up on release or not. I doubt I will even though I'm genuinely looking forward to it. It does look amazing. I just have a list other games/irl stuff to crack on with so waiting until the initial hype has died down isn't an issue for me.
