Facts about the lawsuit, direct quote

I was slightly misinformed, and many people were grossly misinformed. Here is a direct quote from the lawsuit filed against Ryan and Bungie Inc. [quote]O’Donnell is a music composer who is known for, among other things, his iconic work on a number of the most successful and culturally important video game franchises in history, including Halo, which has realized gross sales to date of approximately $3.4 billion. In May of 2000, O’Donnell agreed to become full time Audio Director of the group that later became Bungie, LLC (“Bungie”). Bungie produced the Halo franchise and later became Bungie, Inc. On April 11, 2014, Bungie purported to terminate O’Donnell’s employment as Audio Director “without cause.” Bungie and Ryan gave O’Donnell no explanation for their decision. Bungie has a policy, pattern and practice of paying its employees accrued but unused vacation, paid time off, sabbatical time, and other benefits, and both Ryan and Bungie acknowledged O’Donnell’s entitlement to such benefits and promised to pay them. [b]Applicable law requires that the referenced benefits be paid to O’Donnell. [/b] [b]Ryan has caused Bungie to violate applicable law and the Company’s policies and practices [/b]regarding payment of O’Donnell’s accrued but unpaid vacation time, paid time off, sabbatical time, and other benefits. Separate and apart from the conduct alleged herein, [b]O’Donnell has separate grievances against Bungie and Ryan that are being pursued in arbitration.[/b] If it is determined that the claims O’Donnell asserts against Ryan in arbitration are not subject to arbitration, then O’Donnell reserves the right to amend this Complaint to include those additional claims in this action. [/quote]

        • O'Donnell is being a little bitch. He should suck it up and move onto the next project. Having said that, Ryan should just pay the man. Dunno why he was fired, but Bungie seems like a pretty laid-back company...

                  • I said this on a similar thread, but If Harold is the problem then he needs to go. I mean what reason on earth could he have to fire Marty, much less deny him money owed. And where do Jason Jones and other staff have to say about all of this? Are people afraid of losing their jobs now? Is that the kind of place Bungie is now? I hope not. Jo Staten leaving and now this is making me wonder what is happening at Bungie under Harold's leadership.

                          • He was a music composer working with Paul McCartney. What's the worst he could have done? Outside of arguing with someone, or upsetting the wrong person, or inappropriate work place behavior. "Oh, you've came in late 3 days now Marty, and I'm still not happy about this chord. We're gonna have to ask you to leave." "Marty, I know you're a musician. But the alcohol has to stay at home." I'm a musician but not professional by any means. But I did work within the industry, a music store, selling instruments and such for a couple years. Moved on because of pay, it's a dying industry.

                                  Honestly sounds like a huge argument about nothing filled with smart words for no practical reasoning. Lost vacation time is barely an excuse for compensation imho. Or someone clarify what the hell is actually being suited? This makes little sense, he's sueing over the fact he is entitled to bonuses he never got, some crap like that.

                                        • I agree with a few other members ... in that this claim for "unpaid leave" is not the actual end game. Marty was fired under a "no cause" state, and the suspicion here is that he is forcing bungie to state a cause against which he can launch the real salvo. I hope he finds some justice in this.
