i have no problem with the sale and use of marijuana.
my problem is that there is no field test for sobriety for marijuana like there is for alcohol. marijuana does not effect people in a similar manner, nor is the level of intoxication relatively-linear like alcohol. one joint can affect two very similar people very differently.
being so, if you test positive for marijuana while driving, you would have to be arrested for dui.
until we have a better solution, i dont think it should be entirely legalized.

There is actually a pretty good way to field test for marijuana. Ask them if they think Cheech and Chong is funny. They'll die laughing. Tell them you have Chinese takeout in the back of your car, and they'll chew through the door off in their hurry to get at it. Or you could just give them a pretty picture. If they stare at it for more than 30 seconds, they're high. Jokes aside, if you ask them to follow your finger across their field of vision, their eye movements will be jerky instead of smooth and fluid. This can happen when you're tired as well, but you shouldn't be driving if you're tired anyway. Driving while not at full capacity should be the same penalty as a DUI, it's all dangerous.

Certainly it should be decriminalized though, no need to keep creating criminals and feed if the cartels just because we can't tell if a stoned person is safe to drive. And once a test for cognitive impairment is made then full scale legalization should go forward. Truth is, depending on the strain and person, sometimes driving can be perfectly alright while stoned, and sometimes it could be quite dangerous
