There is only one situation I can think of in which the perpetrator wouldn't be responsible.
If the two partners were copulating but one of them changed their mind at some point without telling the other partner, without showing any disinterest, and encouraged the other partner to continue (possibly just to be polite out of being scared or something), then it's not the attacker's fault.
If there was no way of a sensible person of knowing, it can't actually be their fault.

Edit: This could or could not be considered as -blam!- the victim, but the perpetrator wouldn't be a rapist.

What? A lot of people aren't educated on this kind of thing. It's not common knowledge unfortunately.

What is there to be educated about?

A lot of people don't know how many different ways the act can be committed. Some think it's only when a male grabs a female and "uses" her in a dark alley. People don't realise alcohol and drugs affect the situation, or that consent isn't as clear sometimes.
