Machinima is paying people to talk about Xbox one, not Microsoft. I think that's made pretty clear.
Machinima is paying people to talk about Xbox one, not Microsoft. I think that's made pretty clear.
Quite the opposite actually. http://www.polygon.com/2014/1/20/5327814/report-microsoft-paying-youtube-producers-xbox-one-machinima
Microsoft allegedly made deals with Machinima video partners to pay them extra if they promoted the Xbox One, but only if those video producers kept the agreement confidential, reports Ars Technica. Under the terms of the promotion — which Machinima's U.K. community manager highlighted in a now-deleted tweet — Microsoft would pay content producers a $3 CPM bonus (an extra $3 per thousand video views) if they posted a video with at least 30 seconds of Xbox One gameplay footage in the first two minutes, and verbally mentioned they were playing on an Xbox One. In order for the creators to get paid, the videos had to be labeled with the tag "XB1M13" and posted between 3 a.m. ET on Jan. 13 and 2:59 a.m. ET on Feb. 10.
• It's ironic coming from Polygon... They've been in MS's bed for a long time.

  • http://www.igameresponsibly.com/2014/01/17/microsoft-is-offering-youtube-personalities-good-money-to-promote-xbox-one/ Screen grab says it's Machinima paying. This is the link Ars Technica posted.

  • No, I'm pretty sure the deleted tweet did not mention Microsoft. Go look at a screen grab of it. Polygon likes to sensationalize their titles/articles.

I re-read the contract and the tweet again and you're right no mention of MS. Go figure the one time I take Polygon's word on something :/ That said the money is obviously coming from MS, since Machinima wouldn't do this for free, and ending up in the pockets of youtubers. Who are then not disclosing that they are being paid to endorse. I'm by no means an expert on the legality of it, which is why I've used the word potentially. Even if MS isn't paying the youtubers directly they are paying Machinima. Who's paying the youtubers. There obviously exists a deal between them for this. Whether that constitutes a "connection" is probably up to the FTC. To me it sounds like yes (because otherwise that's a huge loophole that essentially makes the law irrelevant), but again I'm not a lawyer. http://www.ftc.gov/sites/default/files/attachments/press-releases/ftc-publishes-final-guides-governing-endorsements-testimonials/091005revisedendorsementguides.pdf
§ 255.5 Disclosure of material connections. When there exists a connection between the endorser and the seller of the advertised product that might materially affect the weight or credibility of the endorsement (i.e., the connection is not reasonably expected by the audience), such connection must be fully disclosed.
All that being said I've edited the title to reflect that MS may not be paying the Youtubers directly. Thanks for pointing it out.

  • It's not illegal.

I just linked you to the law and why it very well might be. Even bothered to quote it for you. A ton of news outlets are covering this as well with the same reasoning. Saying "it's not illegal" doesn't magically make it legal. Either explain your reasoning or be ignored.

  • Wow, you really got Microsoft here, man. I'm sure their corporate lawyers who are paid six figures can't find a way to get past your sharp eye.
might materially affect the weight or credibility of the endorsement (i.e., the connection is not reasonably expected by the audience)
-Your own quote Now if you think you can prove that you didn't reasonably expect this connection (Which, clearly you did, considering you made the damn thread) in a court of law, feel free. Something I've noticed in gaming communities recently is that everyone thinks they're a super sleuth exposing corporate misdeeds. Come on back down to ground buddy, companies know the law too.

  • Most people try to scream something is illegal even when it's not.

  • MS went through to Machinima to start the promo. MS ended the promo after $3,750/1.25 million views.
