    Apologies, I was being lazy and didn't link the original legislation that the new regulations modify. You need to look at s550za to s550zc of the Education Act 1996, as created by s242 of the Apprenticeships, Skills, Children and Learning Act 2009, in tandem with the new regulations that came into force last year to get the full picture. My reading of it is that the 2012 Regulations were brought in to cover search of mobile phones and other storage devices which may not have been around, or been properly considered, when the previous legislation was introduced (specifically s2(a) - (b) of the 2012 Regulations).
