If they're going by precedent, the Supreme Court has ruled 14 different times that marriage is an American right, and that denying the right to marriage for anyone is unconstitutional. This means that there is a very strong possibility that the final decision will be pro-gay-marriage.
I'm really hoping that state bans on gay marriage are ruled unconstitutional, I know I'm not the only North Carolinian that is very disappointed that our constitution bans both gay marriage and common-law marriage thanks to Amendment 1, which "passed" not that long ago.

Common-law marriage is when a couple lives together for a long time, but don't get married. They get tax benefits and stuff to a married couple, but don't actually get married. One of my coworkers lived with his girlfriend for probably close to 7 or 8 years, and they had two kids together. They aren't married, but they did get the benefits of a common-law marriage.
