It seems like common sense that it's unconstitutional, but you never know with the supreme court. There are a few that might put their personal beliefs ahead of that.

I'm not implying that by asking me you think that it is. But I don't see any other way to answer it. If someone can explain how something that clearly discriminates against a group of people who have not done anything wrong is constitutional. Then feel free to say so.
