I'll always support free speech. But Microsoft, Sony, Activision, Steam, Bungie, and whoever else will all have terms of service. I'm pretty sure hate speech, while protected from government interference, is something most-to-all of those TOS docs set as out-of-bounds on the service. Nothing wrong with wanting blatant hate speech to have ramifications in the private sector.

There is no such thing as hate speech. All speech is protected under the first amendment excerpt for “fighting words” which are threats. Or screaming bomb in an airport. Simple as that. Stop believing what liberals feed you. Racism will always exist. You cannot censor people and the world sucks. There are no safe spaces. Y’all need to get over it.

Do those “racist” players work for bungie? They will surely get fired from their jobs if they are proven to be racists but bungie can’t ban people from saying things on a public game that anyone in the world can pick up and play. They are free to say what they please. Bungie can’t do anything unless they have it written down in their clan page or something. It's irrelevant who they work for. Bungie has terms of use. The code contains the following text amongst their list of offenses: [quote]Disrespect for any reason: race, creed, gender, orientation, or disability.[/quote] Damned near every TOS for a company that takes itself seriously will have similar guidelines.

Alright fantastic. So can you prove that they are racists? Those rules might apply to their forums and written communications but can the OP prove that those people said racist things? I'm not trying to. I'm not debating or competing here. I'm bringing massive, bulbous bags of correct into town for anyone who's interested in facts. Joking aside, I'm merely stating that basic civility as set by service owners is standard operating procedure and has been my entire life. Sure, some won't have them. Some terms will be different. But a company with any care for PR will have something not-so-dissimilar from Bungie's own terms of use and code of conduct. Maybe folks are being racist. Maybe someone is interpreting it differently than they meant to convey it. I don't know, and frankly don't care. That's between OP, these folks, and whichever service providers (if any) he engages.

The supreme court protected it in the case involving the band "The Slants" just a few months back. The decision was written by Alito, who citied hate speech as a thing being protected. It's a real thing in the way pornography is real, in the eyes of the court. It may not be clearly defined, but it's real.

Hate speech is a made up term by liberal activists to combat “racism”. The first amendment is not superseded by a dumb court case a few weeks ago. Hate speech is just another attack on the first amendment. Don’t allow the world to control what you say. People are getting jail time for “hate speech” in England and they aren’t even being racist. You need to square your emotion-driven rants with facts. Hate speech has been recognized by the supreme court, the arbiters of the constitution and our laws. It's loosely defined, but it's acknowledged in at least one decision. The first amendment can be superseded be the supreme court if they interpret in such a way that one finds to be against the intention or writing of the amendment. They're an incredibly important branch of the US government. I'm done here. Godspeed!

They interpret it. If they decide it means something you disagree with, in your mind it's superseded. There are justices that lean towards a 1s and 0s reading, those who lead towards using history to determine intent beyond what's on the paper, those who look beyond our on constitution for guidance in interpreting, and more. So yeah, the folks on the court matter. Their interpretation impacts how future courts read the constitution. Laws are passed and struck down based on what they judge each amendment to mean and how that understanding applies to the case they're hearing. That's why there are often split decisions. C'mon.
