Three days is most likely illegal, depending on where you live.
Whether or not he has cause to kick you out for paying late really depends on your lease agreement. Usually there are stipulations for late charges and you wouldn't be up for eviction unless you didnt pay for whatever agreed amount of time. But, that may not be the case.
Read over your lease and your local/state laws. I'd be pretty shocked if three days is acceptable.
However, you might want to consider the cost of lawyering up and fighting this compared to the cost of simply moving on. Sounds like your landlord is a bonafide asshole and this would probably only be the beginning of the trouble. I'd take photographic evidence of how you're leaving the apartment in case your landlord tries screwing you over on your deposit, which I bet he will.

It is legal. It's a case of pay or quit.. which is very short term (3-5 days)... this isn't just a notice to quit with non-violations.

I understand that and the cause the landlord has to evict. I'm just thinking a lot of areas have certain laws protecting renters from being evicted in such a short time. Maybe I just misunderstood, the guy is getting the eviction notice in 3 days as opposed to having to be out of the apartment in 3 days. Either way, I won't dispute that the eviction is fair and justified. I just know some laws prevent landlords from taking this action.
