I feel devs shouldn't charge you to play a 360 game on the one, and same for the sony side

  • Since developers are very rarely the retailers, it's typically an agreement between the publishers and the console owners. This might not be in every case, but this is just my understanding. So, for example, let's say a made a game and the game was published by a publisher and is sold on the Xbox 360 and the Xbox One. Developer makes the game under the agreement that they have with their publisher. The publisher sells the game in their agreement with the retailer (in this case Xbox/Microsoft). So if the developers want their fans to get a free copy of the game on both consoles if they purchased it on one, they have to talk to their publishers about who will then talk to Xbox. This typically doesn't happen after the beginning of a console cycle since Xbox/PlayStation/GameStop/etc. would be selling at a loss at that point or because there is so little activity on the previous console that providing continued support for it wouldn't be in their best interest. Looking at Bungie, Destiny came out very early into this generation. There was an upgrade program that allowed gamers on the Xbox 360 to get a free copy of Destiny on the Xbox One if they purchased it on or before the 15th of January 2015 on the Xbox 360 (PlayStation had the same). At that point, selling consoles would be more beneficial to their earnings than selling copies of a game that are already selling just as actively on their older console since the average consumer doesn't upgrade right away. In short, this is something that publishers and retailers decide upon, typically with more weight than the developers, though not always. It depends on the contracts and agreements made. This is also very general and I won't pretend to know all the inner workings of the game industry. This is just my loose understanding of it, but I hope it helps.
