Name and shamming is against code of conduct and they can easily be sued for defamation and slander. With the power of the internet that person who be hunted down and ruined. This is a stupid idea.

  • I think you're confused on what he's saying. Banning someone for cheating is not against terms of service, of course, but public defamation/libel and encouraging public harassment by providing and supporting shaming against [i]unverified [/i]cheaters could absolutely get them sued. Even if something is in a ToS, that doesn't mean somebody can't ever sue them and win. Courts have ordered lots of businesses to change their ToS before because their terms were charged illegal.

    They can to see suspicious activity on someone's connection to the game. That gives them power to ban as it's a violation of the TOS we all signed up to. That is enough [u]evidence[/u] of a TOS violation. It's not [u]proof[/u] someone is hacking/cheating and the terms of service does not include announcing bans publicly.

    Yeah it actually can. If they put up the name of someone who another player claimed was a cheater and then that person was wrongfully harassed by the community--facilitated and supported by Bungie--that's something the person could sue Bungie over. They could sue for defamation, mental duress, and harassment. It likely would never get to court and end up in private mediation, but people could do that.

  • Everyone has information associated with their gamertag and if you're forgetting, this is a P2P game where anyone can find out your IP address. Secondly, most people are attached to their gamertags, so even if you can change it, that doesn't prevent forum harassment (or more foul acts) from starting, nor is it an excuse when someone is still innocent. They shouldn't be put in that situation in the first place and changing a gamertag can cost real money, and for every time that person gets accused of cheating (e.g. if someone keeps track of their IP), it's gonna cost them more money to change it again.

  • If you provide proof of him cheating and only hand out the account name, he deserves every shitstorm out there. Period. And if a player cheats and gets a ban in Destiny (or any other game), his console should be banned automatically too. There should be a contract between sony/ms and every gaming company to make this happen.

  • How can you provide proof? The only proof they could show is that there is unusual activity on the players connection. In order to [u]prove[/u] there was a DDODS attack there would need to be an investigation by a legal authority, which bungie are not. This again opens a can of worms for bungie, as there would be a legal requirement to report said crime to a local legal authority if they were publicly alleging that a crime is being committed.

  • No. You can clearly see unusual activity. There is a substantial difference and it cannot be proven that the player is actually responsible for it until there's a proper investigation. IE: examination of hardware etc. You know, evidence.

  • There are more than enough videos proving that someone cheats without looking into the details. If someone goes against 1 or 2 players only because in every game 1 or 2 of the enemies get a disconnect, they're cheating. If someone runs around with godmode, dancing on the capping zone, he's cheating.

  • You're really not getting what I'm saying. Manipulating a connection is a criminal offence in many areas. You cannot prove the crime until you have investigated both ends of the connection. If you publicly alledge someone is guilty of a crime that is not proven, it is defamation of character. Does this compute? You can observe [u]unusual activity from one end of a connection and bungie will suspend players on suspicion of this[/u]. They cannot publicly announce who these players are because they would then be obliged to report the matter to a legal authority and would leave themselves open to legal action should the investigation prove the player was innocent.

  • It's not a person, it's just a gamertag/account. Most of them are fake anyway. So there shouldn'tbe any real courts or laws to protect them like in real life. If someone cheats and you can provide proof, there should be a wall of shame where everyone can see the proof. Period. I really consider to build up a website where everyone can nameshame cheaters without getting punished by Bungle or anyone else.

  • I don't work for blizzard and can't speak for their investigations of players. Nor do I play any blizzard games where it's been implemented. Depending on where you are, manipulation of an internet connection to third parties is illegal. Particularly the aforementioned DDOS attack. So to state publicly that someone is doing it, means you become obliged to report it, and in reverse open to retrospective legal action. Which I've already explained at length. Given that bungie is based in the US, that would be where the crime was reported and in the US DDOS attacks and many other forms of malicious network tampering are federal offences.

  • It's not what they do that is against the law. That's a thing for lawyers. It's about what they do against te gaming community, that's all. No one wants to take legal action against them. We just want to nameshame them if it's legit to do in terms of gaming community behaviour.

    No, if they are DDOSing it is a [u]crime[/u]. It's not a matter for lawyers lol. It's not a matter of "taking legal action" either. They are breaking federal law.
