A few states have been experimenting with laws that allow private businesses the privilege of refusing service to people. The laws are specifically aimed at religious people. The idea is that they should be able to refuse service to somebody provided that offering that service would somehow violate their religious tenets. It isn't uncommon for these laws to be called "anti-LGBT," or "homophobic," or even "racist." The logic in these accusations rests on the presumption that homosexuals will be denied service by religious business owners. Frankly, the argument shouldn't be held over "religious rights." Since when did we have to start disguising basic property rights as religious rights in order to have them protected? A business owner ought to have the right to refuse service to anybody, anytime, for any reason. Hear me out. It sounds cruel, but the opposite is much worse. First of all, if we acknowledge that people have natural rights including property rights, then the debate stops there. If they truly own their business and their labor, then they ought to be able to do what they like with it. Now, we can extend this argument into a hypothetical. Hypothetically, let's imagine that I build chairs. I'm a chair-builder. In a free market, I own my means of production. That means that I own my place of business, my tools, and my labor. It also means I'm the one taking the risk with my business. I'm subject to either a loss or a profit. Now, imagine a vegan walks into my place of business. Imagine that the vegan offers me some money in return for building him a chair. Hypothetically, as one who eats meat, perhaps I'm not comfortable with the thought of this man having a vegan meal while sitting in a chair that I built. Since I own my place of business, my tools, and my labor, I should have the ability to refuse that man service. Even if he wasn't vegan, I should still have that right. If I'm not allowed to refuse by law, a precedent is set. Laws are enforced by violence and the threat of violence, obviously. If I am not allowed to refuse service to someone, the state is in essence forcefully compelling me to build chairs. I no longer own my labor. The state does. Not only is this counterintuitive to a free market, it's also a blatant violation of my natural rights. The hypothetical situation I gave would be an example of private discrimination. Public discrimination (discrimination by the state) is unjustified, since the state must represent its constituents equally. So, what are your thoughts on discrimination?

Thank you for a logical and libertarian view on civil rights, I am disgusted by the civil rights act and how if you oppose it you are deemed a racist.

    • You're right. I just hate it when these no good dirty black people sit in my restaurant as if they had rights equal to the rest of us, it's a violation of my rights that they are allowed in my place of business. How dare they.

      • You know, I don't ever recall people getting pissed about no shirt, no shoes, no service. If I went into a mom & pop store and they told me they won't take my business cause I'm of hispanic origin, I wouldn't care. I'd go to the next business and they'll take my money. It really pisses me off though, that a group of people would go to the government to force a business to go against what the owners believe in. It's sickening that the business owners would lose in a legal fight.

      • People are such over sensitive -blam!-. The management should always have the right to refuse service for what ever reason the manager sees fit. I wouldn't go to a tattoo artists and demand he draws his mother being -blam!- on my arm if he didn't want too. I wouldn't go to a baker and demand he makes a cake with '-blam!- you -blam!- face' on the top if they didn't want to. I wouldn't hire a clown and demand he lets me cream pie him if he didn't want too. So why did that gay couple think they had the right to force another human to do something the really did not want too! That gay couple disgusts me, pathetic. And btw I support the lgb and dislike religion.

        • People who do this just show how unprofessional and immature they are. "I'm not gonna provide you service from my professional business because I personally don't agree with what you stand for." Really? Grow up

Private business should technically have the right, but it still makes them absolute assholes. But not everything that makes someone an asshole should be made illegal.

                • I mean sure I can agree but maybe you should not be able to use the roads that those people (who your refusing service to) paid for. I mean the business exists because its allowed to use resources all tax payers paid for so should you be aloud to refuse them service while they support your business with there tax dollars.

                      • If it's a private business then what they do is up to them. They can discriminate all they want. It's gonna end up hurting them anyway because of all the bad press they'll probably get from the media

                      • The way I see it, the only person hurt by the denial of their service to another person is their-self and their business.

                      • Of course you should be allowed to refuse a customer. That being said it's probably not the best buisness idea to have. Not only do you lose that customer, but they may give a bad review to those they know causing your public image to falter. Along with this though you should never tell them why you refuse if discriminating (just to be a decent human being.) You should just make excuses.

                      • Private discrimination was built by someone who never owned a business. You are literally cutting an entire demographic out of your business figure. No money, no bitches.

                        • Privately owned Companies should always retain the right to refuse service to anyone, for any reason. They are within their right to deny their services to anyone they desire. Should the company decide not to do business with people based on ethnicity, gender, sexual orientation, or religious affiliation, it should not be illegal because we as a society have the right to publicly shame them and hurt their business based on these decisions. There is already no reason to take that right away from them.

                          • Are you kidding me!(just finished reading the post) We had a whole era where we tried to get rid of this crap. Unless the person you are trying to discriminate is literally not able to handle what they are buying(a person arrested for animal cruelty trying to buy a dog) there is no reason to not do business with people due to some attribute like being gay or a vegan. You have they right to disagree with what they believe, but you have NO right to take away their rights. I don't even understand why this is a question.
