So Bungies going to ban alot of innocent people? (3 bungie comments)

The new update had some nice things to say: free map, free stuff on 7/7, and cheaper maps.... But then there was a section of bad news that some of you might have noticed: and it struck more than a few questions across my mind. -how does bungie plan on banning all the people with modded maps, and modded pictures on their fileshares? -how will they implement this new update so every last person with a modded item knows of this update? -and does this update count towards the 100 downloadable files on your harddrive you are allowed? I believe that this update is unreasonable, and heres why it would be illogical: most people who have modded maps on their fileshares are not going to read the front page update. honestly, its a strange thing to ban people who have downloaded these maps. Its more sensible to ban the creators. second, this seems like a very extreme action to take, because modding has yet to hit halo 3's matchmaking. I know its all cautionary, but the thought of being banned from playing halo online over the fact your friend gave you a modded map with extra elephants seems excessive. What is everyones thoughts? What makes a Halo 3 screenshot remarkable is the fact that that was all done by scratch in forge. Look at my friend's, g0alieman, File Share. He made a dinosaour and a freakin' UFO, all in Forge. It was all in the game, no modding. That's what made it cool. Same goes for maps. And to all those who ask "But what if it's not in my file share, will I gey banned?" Well, memory serves there were no File Shares in Halo 2 and people still got banned for modding maps, so yes. You will get banned. To all those who ask "What if it's a screenshot of three guys holding skulls with white flags?" or "What about a game that starts you off with a missle pod?" The simple fact is, if it wouldn't allow you to do it before, and you had to do somthing to the game to get it, yes, it's a mod. Yes, you will get banned. Should there be a warning for this, no. After Halo 2's moddathon catastrophy, you'd think people would have some common sense by now. And to those who downloaded the maps, you should of known better. Why can't we just accept the Halo we have now? Does it have flaws? Yes, but I and many others are fine with it. And if you don't like it, play somthing else. Go play some Garry's Mod and die peeing on yourself (It's saterical, I have nothing against Garry's Mod, or Valve. It was just a GTA4 Lazlow quote.) We do not want you, we do not need you. So please, Live on, Forge on, or Move on.

XD[/quote] i agree with what Recon Number 54 said, parents these days are *edited, removed 25 minutes of bleeps and -BLAM!-'s* so they think even though their kid is legally not supposed to have the game, that since they bought it for them anyway that there should be not content above an E rating that isnt part of the game. i dont know what these pictures were, nor do i care to know, but sounds like it was probably -blam!-... and WHY would you have -blam!- on your Halo 3 file share?

It's happened to me before.[/quote] can you imagine how many times bungie will hear that? maybe 2 out of every 100 times it's the truth. but even if half the time it's the truth, how would bungie distinguish the honest ones from the liers? so, for your own sake, when that happens, jump out of the game immediately!! don't play with those friends anymore if they keep doing it. frankly, you should remove them from your friends' list if you really want to make it obvious to bungie that you didn't want to play that game.

  • i think what people are getting confused about is the grey area between glitches and mods. not the grey area as to whether they violate the terms of use - that is black and white, either you violated it or you didn't. but the grey area of glitches and mods is whether a glitch is a mod, and for most casual gamers, this may be confusing. a glitch is like the foundry map with unlimited money. that is a glitch of an in-game bug. a mod is when you play cold storage and there are 4 hornets, or some other thing that is fairly obvious that it should not be that way. i'll admit, i'm still a little confused, but i figure that if it's a glitch i got from forgehub, or from one of the stickied posts in the bungie.net halo 3 files forum (meaning bungie is promoting it themselves!), then it's probably okay. mods are things that are not supposed to happen in a game EVER! if you have modded material, just get rid of it to be safe. lastly, as an attorney, i have to comment on the recent discussions regarding the terms of use and "accepting" it by clicking the little box. this is not actual consent to the terms of use. now, does that mean that you can't be taken to court? no. does that mean that a judge still won't rule against you? no. but does it mean that you really accepted the terms of use? absolutely not. in fact, courts in recent times have come down very hard on companies that do this and whether the contract is actually valid. many have started to say that the contract is not valid. it's referred to as "unconscionable" you see, when party A provides a contract (or terms of use) to party B and says, "here's the agreement, take it or leave it" - the contract may not be valid. party A wrote the contract, and party B had no say in what the terms were. the contract really only provides protection for Party A, the author of the contract. in fact, party B couldn't change anything in the contract even if he/she wanted to. try e-mailing MS and suggest that before you accept the terms of use, they change a clause to read a different way, or they add a clause. if you're not flat out ignored, you'll probably get a message indicating that the person you e-mailed does not have the authority to change the terms of use but will also not know who does and therefore cannot direct you to a person with whom to negotiate with. that's unconscionable. and companies that know a party will not even read the contract, and are in fact counting on the other party not reading it, tend to upset judges. not to mention that some people "clicking on the accept terms of use" box are under 18. and being a minor is a legitimate defense to enforcement of a contract. mainly, just by clicking on that box does not mean that you are bound to the terms of such a one-sided, take-it-or-leave-it agreement. that being said, i still do not condone modding or cheating. one need not be bound to a contract to understand that one should not do such things. common sense tells us that being a party of this community means we should try to only act in ways that benefit the community, and not hurt it. using modded files for inappropriate pictures and other illegal conduct (like misappropriating someone else's property - bungie's game - for a use it was not intended for) does not benefit the community. instead of worrying about the terms of use, just focus on being a good member of the community. if it's something you know you shouldn't do or have, then either don't do it or get rid of it! stop arguing with bungie or MS and help the community by being a good member. DISCLAIMERS (yes, i put these in here) 1. i am not offering legal advise nor soliciting any business 2. legal arguments are never absolute, judges change their minds, think differently, or sometimes just get it wrong - therefore, there is no guarantee any particular argument, no matter how sound, will be victorious 100 percent of the time 3. i may not be in your state, so laws may be different. likewise, as any suit between yourself and MS could land in federal court, there could other points and authorities to consider in making any legal argument 4. any disclaimer i have not mentioned does not consitute my waiver of such disclaimer, and in fact, i reserve the right to claim any disclaimer not mentioned herein that is consistent or allowed by law in any jurisdiction

  • well modded content that doesnt effect game play shouldn't be banned,if people were running round matchmaking with invincibility then i'd be annoyed but as it is i quite enjoy the user generated maps...i dont put them in my file share but hey whatever, the only thing i would be concerned about is modders seeing this as a challenge and modding moving onto xbox live.

  • My friend has a mod(not going to say name) with the ship in the Ark when the Commander brings those 3 Scorpions and a Warthog. I think it was called the Hangar. But it takes up the whole map of Sandtrap. Only the person with the best connection can see it though.

  • this is sorta off the topic in a way but in team SWAT two ppl on each team quit and I went 41 and 10 and after the game this guy on the other team was cursing nonstop and he threatened that he will suspend me from live cause i was "cheating" and i have the video to prove that i was not cheating so the next day i tried to sign on to live and it said that i was suspended for a day. So i called customer support and I even told them that i knew the gamertag of the guy who got me suspended but he said that he could do nothing and I couldn't find anywhere else to prove to someone and get the other guy possibly suspended because u know he's been doing this to other ppl and I don't want anyone else to get suspended for no reason if u want a link to the video here it is: [url]http://www.bungie.net/forums/posts.aspx?h3fileid=37452758[/url]

But people still are. So to ease bungies and microsofts minds and make sure they don't get like 10,000 complaints saying they were banned from xbox live/matchmaking withouth warning. They could send out that message.
