The appeals court didn't buy that explanation, ruling that the "nearly universal recognition that this gesture is an insult deprives such an interpretation of reasonableness."[/quote] [/quote] Two different things, the officer in the article believed the person was trying to get HIS attention, not other drivers as a signal. If he would of used the explanation given by myself, it might of been different. There are so many different things you can "charge" the person with, it is sort of a catch 22. Some courts will accept it, some won't.
