The Expansion pass can be shared between the 360 and the XBOX ONE under the Digital Upgrade program. This only works when the Expansion Pass is purchased on the XBOX 360 not when purchased on the XBOX ONE.

The only reason I have two copies of the game is because I have friends I play with in either console - and I was told on the store that purchases on one console carry over. In hindsight I should have bought it on the 360 marketplace, or read the small print on the xbox one marketplace - however I've been shown the deal and paid the money - can I either have the money back or just give me the expansion pass on my 360 too?

I am sorry, if you feel like you were given wrong information from the retailer you will need to contact the retailer about the issue.

Also when Bungie states " Yes. Your Microsoft Account (Xbox Live Account) will retain licenses for both consoles." Seeing as I agreed to a "license" with the Expansion Pass on my Xbox One.

I will contact Xbox Live, seeing as they are the "retailer" of my digital expansion pass download, for a simple resolution to obtaining the expansion pass to my Xbox 360. I would also like to note that the link you provided does not specify that a expansion pass purchased on an Xbox One will not apply to the 360, so when Bungie states " Whether you participate in this program or not, your Guardians, progress, stats, and gear are shared within a console family (PlayStation®3<->PlayStation®4 or Xbox 360<->Xbox One) and will be waiting for you when you transition to next-gen" you can understand my confusion in this matter with your use of "<->".
