A question for law students in the UK

Who has the right to demand that they search through what is stored on my phone? My school (a state run grammar school) has recently brought in a new phone policy that allows then to search my phone if they think they have reasonable grounds to do so. I disagree. Anyone? Please back up your reply with sources.

  • Please allow me to sum up most of the responses from your brothers across the pond: THEY CAN'T DO THAT! YOU GOT THE 1ST AMENDMENT THAT SAYS THEY CAN'T DO THAT! YOU GOT RIGHTS AND THEY ARE BREAKING THE CONSTITUTION! GODDAMN IT OBAMA! To be fair, I wonder how many British law students frequent the flood...

    • If it's in their policy, you are bound by it so long as you are a student. It's not up to whether or not you agree, it's up to your acceptance of that policy by being registered under their contract. The best you can do is to read the exact wording of the policy and see if there's any loopholes or exemptions.

      • It's an invasion of privacy and is bad because you could be taking pictures of your cock/vagina and your anus and then they'd see it and they'd accidentally do paedophilia which'd not be good so they can't look at your phone because it's -blam!- of a child. Logic? No, privacy is more important. Just tell him that you can't let him look at it because you have photos of a 13 year old girl's genitals on it.

      • Out of curiosity, why have they brought in this policy exactly?

          • Yes, they have power under The Schools (Specification and Disposal of Articles) Regulations 2012. link

            • I'm in no way a law student but i think its pretty much common sense that a teacher or member of staff at a school have no right to search your phone.

                • Why not just, you know, not give them any grounds to take your phone?
