So, here's the thing about the Second Amendment and gun control laws - either the Second Amendment is clear in its wording that no gun ownership shall be infringed and American citizens should have access to any and all firearms and weapons, making any gun control legislation unconstitutional... ...or it isn't and gun control laws are just fine. Which one is it?

  • Supreme Court has already ruled that no law is absolute and that the government is within it's right to restrict some laws. Hence the machine gun ban that's been in place for ~30 years is constitutionally valid. As was the AWB created in '86(?)

  • The AWB was in 94' I believe because Columbine and Virginia tech both happened during it.

  • Only Columbine happened during the AWB. There were many other reasons why Columbine was the tragedy that it was. At the time, police procedure was to surround the building. Now, they charge straight in. Also, the Clinton AWB was weak and ineffective. Feinstein's bill fixes those loopholes.

  • I don't disagree. My point was that people say that the Second Amendment clearly states that the right to bear arms "shall not be infringed", and gun control laws clearly infringe upon owning certain weapons.

    IMO, it depends on who the law effects. The amendment does insure that we are allowed to own weapons, and that right should not be infringed, but no one wants full automatics on the streets. Semi-autos are another thing however, and should not be banned. Another thing is ammo-- how much should a person have and how large should the clips be? more ammo does not make a gun more dangerous-- it only prolongs the amount of time before reloading, which in the case of a gun free zone doesn't matter. And in the case of a shootout, shootouts only last (on average) about 10 seconds, so again, the larger clip doesn't really matter. a lot of this comes later in the paper as well.
