I'm all in favor of this, but I'm not sure I'm a fan of how the Obama admin has handled it. First, they abandoned their responsibility to defend DOMA (I don't care about your or their opinion on it, I care about officials doing their job), and now they're actively trying to influence SCOTUS' decision (I get that amicus briefs are common, but we have separation of power for a reason and IMO the executive trying to sway the judicial is not compatible with that separation).

  • I don't feel they abandoned their responsibilities at all. This administration disagreed with the law and decided it was in their best interests not to defend it, because they do not feel it should be defended. I do believe that has happened before.

  • Happened on a state level with Prop 8. Governator and Brown refused to defend the bill when it went before the State Supreme Court.
