People could easily abuse it but the real thing to consider is "would it be a problem?" I think most would follow the rules, a handful would tip toe the boundaries but overall Xbl costs money. The members sporting vs avatars would have their live accounts banned, I doubt enough trolls would do it for it to be a problem because of that.
