Rapist asks for visitation rights for the child of his victim

And he might just get it. Essentially, guy rapes underage girl, girl gets pregnant and chooses not to do abortion, child gets born, rapist is ordered by a judge to do child support in exchange for 16 years probation, which causes a problem as, in MA, if you pay for child support, you can get visitation rights. •
Posted by: MadMax888 Statutory -blam!- can be consensual, and doesn't even have to be actual intercourse. The mere fact that not all the participants were of legal age of consent is what makes it statutory -blam!-.
I know that just means there is a possibility that she consented. Though that doesn't mean that she was not raped. The main issue here is that the article is lacking the necessary details to really give an accurate say in the matter.

 • The article [and this thread] are intentionally misleading. It was STATUTORY -blam!-. That's different.

 • This is why the whole "Sex offender" system is completely -blam!- up. From violent multiple-offense gang rapists to "stupid guy who doesn't look at the law and realize he can get in serious trouble for a consensual relationship", the entire world points and yells "RAPIST! WORST OF ALL CRIMINALS!"

 • ... I dont see the problem, I read the title and not the article so forgive me if im missing something but... Yes he is a monster and a rapist but he has a child... If anything this shows that he legitimately feels something for a child he helped create and just wants to spend time with it, Its not really wrong... What he did is wrong, How the child was conceived is wrong, A father fighting to see his child is touching. EDIT: Wait it was STATUTORY -blam!-? Oh then this entire thread is pointless, Let the man see his -blam!- kid. [Edited on 09.26.2012 11:06 PM PDT]

 •
Posted by: Doc Bacon This was after the sex, after she had agreed. This was when she decided she did not want to be regarded as a 14 year old slut and realized maybe having sex with her sisters boyfriend was a bad idea. The acts that got her pregnant and the multiple times they did it was all consensual
How do you know it doesn't say that in the article? If you can link me to another article about the same girl that supports this then I will agree. Until then you are just trying to build a false scenario that supports your side of the argument given the little facts that we have.

 • Whilst I do not approve of -blam!- in any way, it is not always black and white. The two parties involved did agree to consensual sex even though she was below the age of consent which is only a legal age. Whilst it is law she and him both chose to break the law. Which is the fault of both parties. More so since he did not force her and she did it of her own accord. Personally I believe that she should be eligible for visitations with his child. I guess I have to agree with the Doc on this one.

 •
Posted by: Doc Bacon
Posted by: theHurtfulTurkey
Posted by: Doc Bacon The sex was still consensual, he did not attack or force himself on her.
Debatable. You'd be hard-pressed to convince a judge or jury that the girl was mature enough to be able to make an informed decision, and legally it simply can't be consensual before the age of consent.
At 14 you are old enough to know right from wrong, what adultery is, and that it is illegal to have sex with somebody who is 20 when you are 14. What really bugs me is how the article acts like the girl is an innocent victim of a traumatizing -blam!-. There were multiple accounts, she did this with him multiple times. The article is just biased in her favor. Her, look at it like this. If the man was 14 and the woman 20, would they take the baby from the woman and accuse her of being a malicious rapist? exactly
I guess it depends on how willing she was, she said that she was threatened and scared for her life or something along those lines.

 •
Posted by: Bearded Elf That's her statement after the mother finds out. Who knows what she really thought before her parents became involved. She is probably terrified of what her parents would do if she said it was all consensual and wanted to have sex with some 20 year old guy she knew.
True I won't deny that she could be lying. Either way the guy is legally allowed to see his child even if he did -blam!- her or if it was consensual.

 •
Posted by: What Is This1
Posted by: Doc Bacon "the relationship was consensual, even though he acknowledged it was inappropriate, given the victim was only 14 and his client was 20."
You excluded the most important part of the sentence.
But he did claim the relationship was consensual, even though he acknowledged it was inappropriate, given the victim was only 14 and his client was 20.
Notice the he part of it that means his statement is one sided and most likely is not true especially especially after that she said.
He threatened me. He told me that he could make my life upside down, and I wouldn't have anybody and he would pin it all on me. So I was scared,

That's her statement after the mother finds out. • From what I read, and my years of watching SVU. All I see is a girl who had consensual, but still illegal, sex with an older man. When the parents found out, she cried *Insert word for forced -blam!- actions here*, and the mother exaggerated to the news. In which fox, and their willingness to overreact, painted him as a violent criminal. If this is just an inappropriate relationship, and all was consensual with the only issue being age. He should get to see his kid. I could be wrong though. [Edited on 09.26.2012 10:47 PM PDT]
