Destiny couldn't have started development while bungie was with M$. If so, it would have belonged to M$.

Not necessarily, despite being under MS bungie was a rare breed that retained ownership of the Bungie IP. The easter egg in Halo 3 ODST showed destiny was at least being developed.

It was in development since 2007. I forget exactly the month, though.
