Is it to late to sue Bungie for Halo?

I have heard about people wanting to sue Bungie because Destiny isn't like Bungie was saying a year ago. I was wondering if by that logic it would be fine to sue Bungie for releasing Halo as an FPS on the Xbox in 2001 instead of the real time strategy game for Mac they announced in 1999. Even after the Xbox version was announced many features they talked about didn't make it into the final game. Now that the internet is as big as it is and the gaming industry has grown so much have our views on videogames just changed or would it be justifiable to sue bungie for the first game in their previous franchise for the same reasons people have talked about it for this new one.
Just something trolly trying to comment on how now that the internet is so open and people can wage mini wars over stupid shit and how games change a lot in development. Not trying to be a fanboy.
• There are a lot of gray areas in gaming when it comes to false advertising. Gearbox software had it happen with their aliens game. Due to the way games are developed content shown in a trailer can be changed or completely cut due to vision changes, financial reasons, time deadlines, etc., devs aren't held to the same standards as say a cellphone that boasts having a 5 megapixel camera yet it only has 2.5 then that would be false advertising.
