Why can't BUNGiE sue IGN? Or can they?

If BUNGiE wasn't planning on revealing anything yet what gave IGN the right to post leaked images? Is there not a law or something to stop that kind of thing? What the hell BUNGiE? Kick their asses! Also could they if they wanted to?

The way they can control them is to take information that they would have taken to IGN to a different outlet.
